Simple Car Rental Inc. Vehicle Policy

 

1. 1.      RESPONSIBILITY FOR LOSS OF OR DAMAGE TO THE VEHICLE:

The Renter shall pay Simple Car for all loss, damage, and/or mechanical repairs to the vehicle and accessories, regardless of fault. If he or she has agreed to pay the Loss Damage Waiver fee or the Limited Damage Liability fee and has complied with the terms contained on the agreement, his or her liability for loss or damage shall be waived entirely or shall not exceed the amount stated depending upon the option selected by the Renter in singing one of the boxed on the other side of this agreement.

1. 2.      LOSS DAMAGE WAIVER DOES NOT COVER THE FOLLOWING:
2. ANY DAMAGES OR CHARGES INCURRED IF THE VEHICLE WAS OPERATED IN CONTRAVENTION OF A TERM CONTAINED IN PARAGRAPH 3 BELOW:
3. DAMAGE TO THE TIRES, RIMS, WHEEL COVERS, THE INTERIOR OR THE UNDERCARRIAGE OF THE VEHICLE;
4. DAMAGE TO THE ROOF AND SIDES OF THE VEHICLE AND AIR SHIELD DUE TO INSUFFICIENT HEIGHT AND/OR WIDTH CLEARANCE;
5. DAMAGE ARISING FROM THE VEHICLE BEING OVERLOADED, IMPROPERLY LOADED, OR RESULTING FROM AND INSECURE LOAD;
6. DAMAGE AND/OR MECHANICAL REPAIRS TO THE VEHICLE ARISING FROM TRAVEL OFF OF PAVED HIGHWAYS;
7. TOWING AND STORAGE CHARGES;
8. LOSS OF USE CHARGES; AND
9. LOSS, DAMAGES OR THEFT OF VEHICLE(S) RETURNED AFTER HOURS UNTIL VEHICLE(S) IS INSPECTED BY SIMPLE CAR, REGARDLESS OF FAULT.
10. 3.      PROHIBITED USE:

The vehicle referred to on this agreement shall not (whether in motion or stationary and regardless of whether or not the key is in the ignition) be handled, used, operated or driven by any person;

1. Not specifically name on the agreement;
2. Who has obtained the vehicle by using false or misleading information;
3. While under the influence of any drug, alcohol or other intoxicant;
4. To carry more persons than there are seat belts;
5. For transporting persons for hire or compensation; or for rehire;
6. To tow or push any trailer, vehicle or other object;
7. OUTSIDE BRITISH COLUMBIA WITHOUT SIMPLE CAR’S WRITTEN CONSENT;
8. To carry hazardous, explosive or flammable substances;
9. In any race, training activity, contest, or any illegal or unlawful purpose;
10. If the vehicle is damaged or in need of repair The Renter will responsible for all damage to the vehicle resulting from such use.
11. 4.      VEHICLE RETURN:

Renter will return the vehicle in the same good condition, and without mechanical, interior, clean or body damage, to the rental location or other designated place on or before the due-back date. Simple Car will estimate and inspection the return vehicle, Renter will be charge FINES for the bad condition. Cleaning charged $80 will be levied if the vehicle is returned excessively soiled or dirty.

 

1. 5.      LOSS OF USEE:

The renter agrees to pay Simple Car liquidated damaged equal to the regular daily rental rate of the vehicle for each day the vehicle is unavailable for rent, regardless of fault, while any damage and/or mechanical repairs are made.

1. 6.      VEHICLE REPAIRS AND ALTERATIONS:

The Renter will not permit any repair or replacement to, or alternation of, any part on the vehicle without the written consent of the renting location and the Renter agrees to pay for all costs associated with such unauthorized repairs and replacement parts, as well as the cost of restoring any authorized alterations.

1. 7.      REPORTING OF ACCIDENTS & THEFT:

All accidents, theft or acts of vandalism involving the vehicle must be reported by the Renter to the police and a report completed at the renting office within 24 hours of the incident. Also, the Renter or violations laid by the police or government authority arising out of the operation of the vehicle.

1. 8.      PAYMENT:

Regardless of whether or not the Renter is negligent in using the vehicle, the Renter shall be responsible to Simple Car and shall pay to Simple Car all loss or damage to the vehicle, including towing and storage charges. The Renter shall pay Simple Car all amounts owing pursuant to the agreement. The Renter agrees that if any person or company agreeing to make payment pursuant to this agreement (as contained in the Cardholder section on the pursuant to this Agreement) fails to make payment, the Renter shall, on demand, pay all charges. The Renter authorized Simple Car to debit or credit the Renter’s charge and/or credit account of the return of the vehicle with any additional amounts resulting from any error of calculation on this contract.

1. 9.      TICKET, & FINES:

The Renter shall be liable for all fines, photo radar tickets and other costs associated with traffic and parking violations issued during the rental period. If the Renter return the vehicle without paying any TICKET, & FINES. Simple Car has authority to charge double on the TICKET, & FINES.

10.  I.C.B.C. VEHICLE IMPOUNDMENT PROGRAM:

Renter is responsible to ensure the rental vehicle is only operated by individuals who hold a valid driver’s license. Renter is responsible for all costs incurred should vehicle be impounded.

11.  CLAIMS:

The Renter agrees to pay Simple Car a $800.00 administration Fee per occurrence, regardless of fault.

12.  REPOSSESSION:

Simple Car may terminate this Agreement and repossess the vehicle at any time or place.

13.  PERSONAL PROPERTY:

Simple Car shall not be liable for loss of or damage to any property left or stored in the vehicle either during the rental period or after the return of the vehicle to Simple Car. The Renter hereby assumes all risk of such loss or damage and waives all claims against Simple Car.

14.  UNATTENDED VEHICLE:

The vehicle shall not be left unattended unless the windows have been closed, missing or stolen and the Renter does not have the keys to return to Simple Car, the Renter is totally responsible for loss of the vehicle.

15.  LOADS:

The Renter agrees to pay Simple Car for any and all damage and/or mechanical repairs resulting from the vehicle being overloaded or improperly loaded, or resulting from the insecure load.

16.  REDISTRIBUTION:

If Renter returns vehicle to any location other than the renting location, renter agrees to pay regular rates plus applicable redistribution charge or towing charge.

17.  FUEL AND SERVICE CHARGE:

1. The Renter is responsible for any fuel siphoned from the rental vehicle.
2. The Customer is required to return the vehicle with at least the same amount of fuel as was in the vehicle when the Customer receives the vehicle;
3. If the Customer elects not to refuel the vehicle to the same level as when the vehicle was received, the Customer shall pay to Simple Car an amount equal to the actual cost incurred by Simple Car in refueling the vehicle plus a service charge of $40 of fuel required to refuel the vehicle to the original level.

18.  TOWED VEHICLE:

1. Any vehicle(s) towed by the rental vehicle are not covered by Simple Car.
2. If the vehicle referred to on the agreement is damaged by a towed vehicle, the Renter shall pay Simple Car for all damage, loss of use and towing.

19.  DELAYS AND BREAKDOWNS:

Simple car is not responsible for loss of time, wages, and inconvenience, loss of use of the vehicle or other consequential damage or experience.

20.  LICENCES AND PERMITS:

Any additional licenses or permits required by provincial or state authorities are the responsibility of the Renter.

21.  OVERNIGHT RETURNS:

Renter is responsible for any damages to the vehicle or theft of vehicle returned after office hours until vehicles are inspected by Simple Car.

22.  AUTHORIZED USE:

The vehicle may be used only by an authorized driver, an authorized driver is:

1. You, the customer, And/or; (b) A licensed driver who has been accepted by the company as an additional driver in the contract.

23.  The Customer authorizes Simple Car to process credit card voucher for any amount payable to our recoverable by Simple Car under this Agreement are subject to final audit by Simple Car, including charges for refueling (which are estimated at the time of return).

The Customer authorizes Simple Car to Debit or Credit the Customer’s credit card account at any time(s) after the return of the vehicle to Simple Car for any and all adjustments to and final calculations of the amounts owed to Simple Car under the rental Agreement.
